1. Acceptance of terms

By creating an account or using ImmoMagic, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the service.

ImmoMagic is operated by Hakan Ozturk (micro-entrepreneur, Paris, France). These terms are governed by French law.

2. Service description

ImmoMagic provides AI-powered interior visualization for real estate professionals. The service transforms uploaded or captured photos of real properties by applying digital style presets. It is offered as a self-service tool using credits.

3. ETHICAL USE POLICY

ImmoMagic visualizations may only be used in post-showing follow-up communications with buyers or tenants who have already visited the property in person.

The following uses are strictly prohibited:

• Including visualizations in MLS listings, property portals, or any public-facing property advertisement.
• Using visualizations in social media posts, print materials, or online ads that could reach buyers who have not seen the property.
• Presenting visualizations as photographs of the property's current condition.
• Using visualizations in any way that could mislead a buyer, tenant, or investor about a property's current state.

Consequence of misuse: Violations of this policy may result in immediate account suspension without refund, and may expose you to liability under applicable consumer protection and advertising regulations. ImmoMagic disclaims all responsibility for any legal, financial, or professional consequences arising from misuse of the service.

This policy exists because most MLS platforms and real estate regulatory bodies prohibit digitally altered photographs in listings. Our service is designed to be used in full compliance with those rules.

4. Account responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must not share your account with others or allow others to use your credits. You must provide accurate information when creating your account and keep it up to date.

5. Credits and payments

Instant transforms use credits. Credits are purchased in packs via Stripe. Credit pack purchases are non-refundable once completed, as credits are delivered immediately upon payment.

If a transform fails due to a technical error, the credit used will be automatically returned to your account.

Prices are displayed in USD and are exclusive of applicable taxes. ImmoMagic reserves the right to change pricing with reasonable notice.

6. Intellectual property

Your input images: You retain ownership of all photos you upload. By using the service, you grant ImmoMagic a limited, non-exclusive license to process those images to deliver the service.

Transform outputs: ImmoMagic grants you a non-exclusive, non-transferable license to use the transformed images in accordance with the Ethical Use Policy above. The transformed images may not be sublicensed, resold, or used for purposes other than those permitted under these terms.

ImmoMagic platform: The ImmoMagic platform, branding, design, and underlying technology remain the sole property of ImmoMagic. You may not copy, reverse-engineer, or create derivative works from any part of the platform.

7. Limitations of liability

ImmoMagic is provided "as is." We do not guarantee specific results from any visualization. The service relies on AI models that may occasionally produce imperfect outputs.

To the maximum extent permitted by applicable law, ImmoMagic shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service, including any professional or legal consequences resulting from misuse as described in Section 3.

8. Governing law

These Terms of Use are governed by French law. Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Paris, France.
