Terms of Use

1. Acceptance of terms

By creating an account or using ImmoMagic, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the service.

ImmoMagic is operated by Hakan Ozturk (micro-entrepreneur, Paris, France). These terms are governed by French law.

2. Service description

ImmoMagic provides AI-powered interior visualization for real estate professionals. The service transforms uploaded or captured photos of real properties by applying digital style presets. It is offered as a self-service tool using credits.

3. ETHICAL USE POLICY

ImmoMagic produces visualizations that show what a space could look like. They are not photographs of a property's current condition, and they must never be presented as such.

You may use ImmoMagic visualizations in property listings, portals, social media, and public marketing, provided that every published visualization meets all of the following conditions:

• It is clearly and conspicuously disclosed as virtually staged or AI-generated.
• The original, unaltered photograph of the same space is made available alongside it, or through a clearly indicated link.
• It is never described or implied to be a photograph of the property as it currently exists.

The way you disclose a visualization depends on the rules that apply to you. Some MLS boards require the disclosure to appear on the image itself. Others prohibit any third-party mark on listing photos and require the disclosure to appear in the photo description or the listing remarks instead. You are responsible for using the disclosure method that your board, MLS, and brokerage require.

The following uses are strictly prohibited:

• Publishing a visualization without disclosing that it is virtually staged or AI-generated, by whatever means your board, MLS, and brokerage require.
• Publishing a visualization without making the original unaltered photograph available.
• Using visualizations that materially misrepresent the property, including altering or removing structural features, fixtures, flooring, wall condition, defects, views, or surroundings, or depicting furniture at a scale that misrepresents the size of a room. No disclosure makes this acceptable.
• Presenting any visualization as documentation of a property's actual current condition.

Your own compliance obligations. Disclosure requirements for digitally altered property images vary by jurisdiction, MLS, and brokerage. California's AB 723, in effect since January 1, 2026, requires clear disclosure of digitally altered listing images and access to the original photograph, and treats willful non-disclosure as a misdemeanor under state real estate licensing law. Other states and MLS boards have their own rules. You are responsible for knowing and following the rules that apply to you. This does not constitute legal advice and does not guarantee compliance in any specific jurisdiction.

Consequence of misuse. Violations of this policy may result in suspension or termination of your account. Misuse may also expose you to liability under applicable consumer protection, advertising, and real estate licensing laws.

4. Account responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must not share your account with others or allow others to use your credits. You must provide accurate information when creating your account and keep it up to date.

5. Credits and payments

Instant transforms use credits. Credits are purchased in packs via Stripe. Credit pack purchases are non-refundable once completed, as credits are delivered immediately upon payment.

If a transform fails due to a technical error, the credit used will be automatically returned to your account.

Prices are displayed in USD and are exclusive of applicable taxes. ImmoMagic reserves the right to change pricing with reasonable notice.

6. Intellectual property

Your input images: You retain ownership of all photos you upload. By using the service, you grant ImmoMagic a limited, non-exclusive license to process those images to deliver the service.

Transform outputs: ImmoMagic grants you a non-exclusive, non-transferable license to use the transformed images in accordance with the Ethical Use Policy above. The transformed images may not be sublicensed, resold, or used for purposes other than those permitted under these terms.

ImmoMagic platform: The ImmoMagic platform, branding, design, and underlying technology remain the sole property of ImmoMagic. You may not copy, reverse-engineer, or create derivative works from any part of the platform.

7. Limitations of liability

ImmoMagic is provided "as is." We do not guarantee specific results from any visualization. The service relies on AI models that may occasionally produce imperfect outputs.

To the maximum extent permitted by applicable law, ImmoMagic shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service, including any professional or legal consequences resulting from misuse as described in Section 3.

8. Governing law

These Terms of Use are governed by French law. Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Paris, France.
